Terms of Service

Welcome to Imfundo. These Terms of Service are a binding agreement between you and EDUPILOT (PTY) LTD, Registration No. 2026/555687/07 ("EDUPILOT", "Imfundo", "we", "us" or "our"), the South African company that owns and operates the Imfundo service. By creating an account or using Imfundo, you agree to these Terms of Service.

Service

Imfundo is an AI-powered educational platform that helps South African teachers generate CAPS-aligned teaching resources, including lesson plans, worksheets, teaching packs, PowerPoint presentations and other classroom materials.

Accounts

Users are responsible for maintaining the security of their accounts and passwords, and are responsible for all activity under their account.

Subscription plans

Some features require an active paid subscription. Access to premium features depends on your selected subscription plan.

Payments and subscription terms

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle.com is the authorized reseller that processes all orders, handles billing, tax and invoicing, and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically unless cancelled before the next billing cycle. Acceptable use

You agree not to:

• Use the platform for unlawful purposes, fraud or spam.
• Share your account with others.
• Attempt to bypass subscription limits.
• Infringe the intellectual property rights of others.
• Interfere with the security of the platform, including malware, probing or scraping.
• Reverse engineer or misuse the platform.

AI-generated content

• You must not use the platform to generate illegal, harmful, deceptive, hateful or infringing content, and must not attempt to jailbreak or misuse the AI features.
• You are responsible for your prompts, how you use outputs, verifying their accuracy, and ensuring you have the rights to any content you input.
• We may moderate, filter, remove or restrict content and outputs, and suspend accounts, to enforce these Terms. Rights-holders may report infringing content to us, and repeated infringement may result in termination.
• AI outputs may be inaccurate or incomplete and are not a substitute for professional judgement. Teachers remain responsible for reviewing all AI-generated content before classroom use.

AI generated educational illustrations

Imfundo includes AI-powered educational illustration features. These features may generate:

• Cartoon illustrations of people
• Cartoon illustrations of animals
• Stylized educational characters
• Realistic educational illustrations of humans where appropriate

These illustrations are intended solely for educational and classroom purposes. Users are responsible for ensuring that generated content complies with applicable laws and does not infringe on the rights or privacy of others. The platform may restrict or refuse prompts that violate our content safety policies.

Intellectual property

• Users own the teaching resources they create.
• Imfundo retains ownership of the software, branding and platform technology.
• Users are responsible for reviewing AI-generated content before classroom use.

Service level

Imfundo is provided “as is” and “as available.” We do not guarantee that the service will be uninterrupted or error-free, and disclaim all implied warranties to the fullest extent permitted by law. Teachers remain responsible for verifying all educational content before use.

Suspension and termination

We may suspend or terminate your access to the platform in the event of a material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations.

Limitation of liability

To the fullest extent permitted by law, Imfundo shall not be liable for indirect, consequential or special damages, and our aggregate liability is limited to the fees you paid in the 12 months preceding the claim.

Changes

We may update these Terms from time to time. Continued use of Imfundo constitutes acceptance of the updated Terms.
